General Terms of Trade 

1. COPYRIGHT
All the jewellery designs on this website are the artistic and intellectual property of Northan. These goods were all designed and modelled by Alban Depper, and are copyright to him. Although many original archeological finds were used in the design of these pieces, the actual modelling, including deliberate variations on historical pieces, was undertaken solely by Alban Depper, and remain his artistic property. Any use of these designs without express permission from Alban Depper, is a violation of this copyright, and will be vigorously prosecuted with the full force of the law. This includes such violations as usage of these designs for any kind of printing, garment manufacture, tatooing etc.; also any copying of these models, either from illustration or remoulding of the actual pieces, for the manufacture of jewellery or 3-dimensional representations.
We will strongly and absolutely defend this artistic right, and several copiers and violaters of this copyright have already been sucessfully prosecuted.

2. SETTLEMENT OF CONTRACT/GENERAL
The following terms of trade apply to all contracts, deliveries and services within Northan (ID details under point 13 below). We hereby strictly contradict any divergent rules of the contracting party. Northan is entitled to alter these terms of trade with an appropriate term of notice. Any outstanding orders will be covered by the old terms of trade.

The receipt of this order is followed by an automatic acceptance of order.
The purchase contract is made binding by either this acceptance of order or by delivery of the ordered goods.

3. SUPPLY
The offer of products and services in the online shop is not binding. They are a request for the purchaser for a corresponding offer. There is no minimum order for any of the articles. All our prices include the value added tax (VAT). These agreed prices apply only to the items at the time of order.
Small variations in colour, weight, quality and suitability for use may occur and do not constitute grounds to claim against the vendor. This is to account for small irregularities to be expected from handmade goods.

4. DELIVERY AND PAYMENT
We reserve the right to make a split delivery, as long as the customer agrees. Any special types of delivery, as asked for by the customer, will be charged at the relevant rate. This delivery is undertaken by DPD, DHL or similar delivery services of our choice. We accept international transfer and Paypal , both as payment in advance. Amounts must be paid in full and a receipt will follow.
Note on packaging: we conform to the German recycling rules, (Grüne Punkt of the Dual System Deutschland AG or RESY).

5. DELIVERY TIMES
Goods that are in stock are normally sent within 5 days of receipt of order. If anything is not in stock we will strive to produce and deliver them as swiftly as possible. You will be notified of this by email. In extreme cases (war, pestilence, natural disaster, industrial action or one of God’s “little jokes”), we will notify you of any delay to be expected, in writing. After any further delay, not notifed, the customer can be released from contract. Same applies for the vendor, if the delays take more than 2 months. The vendor is not liable for any damages due to such delays, unless the owner of Northan is guilty of gross negligence. The delivery time starts after receipt of payment by the vendor.

6. RETURNS AND REFUNDS
The customer may return the goods within 2 weeks, by post, without any necessary explanation. This period of two weeks begins after the customer receives the goods. This also applies to the first part of a split delivery. (We meet the information requirements of the German law §312c Abs.2 BGB in connection with §1Abs. 1,2 and 4 BGB. InfoV). We accept responsibility for the costs and risks of return. Returns and notification of returns must be sent to:

Damage to any returned goods will have to be paid for. This does not apply to any damage incurred whilst testing under normal circumstances – such as would be appropriate in a shop. You can avoid this by treating the goods carefully so as not to lessen their worth. Payment to any damage incurred on the returned goods, by the customer, must follow within 30 days. This period begins with the receipt by the vendor of any returned goods.

EXCEPTIONS TO RIGHT OF RETURN
Right of return does not apply to goods specially ordered to suit the customers requirements (such as belts cut to size, orders in gold or orders with alterations specially comissioned by the customer).

7. TRANSFER OF RISK
All risks and liability are transferred from the vendor to the purchaser upon acceptance of the delivery by the purchaser. This includes storage and shipping liability.

8. GUARANTEE
Northan guarantees that the goods are free of material or manufactural defects and are of the quality referred to in the online shop. In fact, we not only guarantee it due to legal requirements, we are also proud of it.
The purchaser should inspect the goods for defects on receipt. Any claim in the guarante must be accompanied by details, including date of receipt.. Returned goods must include enough payment for delivery, ie. be sufficiently franked. The guarantee no longer applies when the goods have been changed in any way. Northan will replace or repair defective goods free of charge, in agreement with the purchaser.

9. RIGHTS OF OWNERSHIP
The delivered goods remain the property of Northan until full payment has been received. After payment in full and receipt of the goods by the purchaser, responsibilty and liability for the goods pass to the purchaser. There is no further need to declare this. This transfer or responsibility applies to any subsequent resale, including right of return.
Any delay or refusal of payment on the part of the purchaser empowers the vendor to reclaim costs by laying claim to property of the vendor of equivalent value. This applies when the return of the goods is not possible, or the goods returned have suffered damage.
Anyone who purchases the goods from Northan for resale is obliged to charge the appropriate amount for them, so as not to devalue the goods offered by Northan. Until this sub-purchase is paid for in full to Northan, the goods remain the property of Northan. If the sub-purchaser is unable to pay, then Northan may seek compensation or return of goods from the sub-purchaser’s customers.

10. COMPENSATION
We deny liability for any of our products that are used inappropriately.

11. SECURITY OF DATA
We use your personal data ONLY for the processing of your order. We act in strict accordance with the German data protection law (BDSG and TDDSG). We only pass on your data to further parties who need it to complete the transaction (e.g. shipping services). They will only receive the minimum amount of data necessary to complete your order.

12. VALIDATION OF THESE TERMS OF TRADE
Changes and supplements to terms of trade are only valid if confirmed in writing by the management of Northan.
